iii.audioHysterical

Terms and Conditions

These terms cover Hysterical, sold by Earlfriend LLC, doing business as iii.audio. Effective October 31, 2026.

Buying Hysterical

Our order process is conducted by our online reseller, Paddle.com. Paddle is the Merchant of Record for all our orders, and handles payment, tax and billing questions. See Refunds for our refund terms.

End User Licence Agreement

This Agreement is between you and Earlfriend LLC, a limited liability company organised under the laws of the State of Louisiana, doing business as iii.audio (“we”, “us”). It covers the Hysterical plugin software, including its documentation and any updates we provide (“the Software”).

By installing, copying or using the Software you accept this Agreement. If you do not accept it, do not install or use the Software, and if you have paid for it, contact us for a refund under Section 11.

1. What you may do

We grant you a personal, non-exclusive, worldwide licence to use the Software to make and produce audio, including audio you sell or license commercially. There is no additional fee or reporting obligation for commercial output, and we claim no interest in anything you make with it.

One person, any number of machines. The licence is granted to you as an individual, not to a computer. You may install and use the Software on as many machines as you personally own or control, provided you are the only person using it. If more than one person needs to use the Software at the same time, each person needs their own licence.

If you bought the licence in the name of a company, the company may designate one individual to use it, and may change that individual by notifying us.

You may make copies of the Software for backup and archival purposes.

2. What you may not do

Except where this Agreement or applicable law expressly permits, you may not:

  • distribute, sell, rent, lease, lend, or share the Software, or make it available to anyone else, including on a network or file-sharing service;
  • share your licence key, or bypass or disable the licence key check;
  • reverse engineer, decompile or disassemble the Software, or attempt to derive its source code, except to the extent this restriction is unenforceable under the law that applies to you;
  • remove, obscure or alter any copyright, trademark or licence notice in the Software or its documentation;
  • use our names, logos or trademarks — including “Hysterical”, “iii.audio” and “Earlfriend” — to promote anything, without our written permission.

Section 3 overrides this section for the third-party components listed there. Where those components’ own licences grant you rights this section would otherwise restrict, their licences govern.

Transfer. Despite the first item above, you may permanently transfer your licence to one other person, provided you transfer it in full, keep no copies, and tell us who it went to. A licence may be transferred once.

3. Third-party components

The Software includes components written by others and used under their own licences. Those components remain governed by those licences, not by this Agreement, and nothing here reduces the rights they grant you.

The complete text of every such licence is reproduced in two places, both of which travel with the Software:

  • inside the plugin, under Third-party licences in the About panel, reached by clicking the iii.audio mark; and
  • in the file NOTICES.txt distributed alongside the Software.

We deliberately do not restate those licences here. The notices are generated from the licence files actually compiled into each build, so they cannot drift out of date; a summary in this document could.

4. Ownership

The Software is licensed, not sold. We and our licensors retain all right, title and interest in it, including all intellectual property rights. You get the rights this Agreement grants you and no others.

Audio you produce using the Software is yours. This Agreement gives us no rights in it.

5. Updates and support

All updates to version 1.x are included at no charge. Later major versions may be charged for.

Support is provided at https://iii.audio/#help on a reasonable-efforts basis. We do not commit to a response time, to supporting any particular host, or to keeping the Software compatible with future operating systems or hosts.

6. Privacy

The Software does not collect, transmit or store any information about you or your use of it, other than the licence key you enter, which stays on your computer. It contains no analytics, no usage reporting, no online activation and no automatic update mechanism. The key is checked on your computer, and the Software makes no network connections of any kind.

The only exception is that clicking a link in the About panel opens that address in your own web browser, at your request. What happens after that is between you and your browser.

If a future version adds anything that communicates over a network, we will say so plainly in that version’s release notes and update this section before release.

7. Term and termination

This Agreement applies for as long as you use the Software.

It ends automatically if you materially breach it and do not fix the breach within 30 days of us telling you about it. On termination you must stop using the Software and delete all copies. Sections 4, 8, 9 and 10 survive termination.

You may end this Agreement at any time by deleting all copies of the Software.

8. No warranty

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT IT WILL WORK WITH ANY PARTICULAR HOST OR HARDWARE, OR THAT DEFECTS WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in this Agreement affects any statutory rights you have as a consumer that cannot be waived by agreement.

9. Audio output and your equipment

The Software is a saturation and level processor. Depending on its settings, its input, and how it is used, it can produce output that is louder than its input, and it can produce unexpected output if it is misconfigured, if a host behaves unexpectedly, or if it fails.

Protect your ears, your monitors and your listeners. Do not use the Software in live performance, broadcast, installation or any other setting where unexpected output would cause harm, without first testing it under the conditions you intend to use it in, and without appropriate limiting and level protection downstream of it.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, RECORDINGS, PROJECTS OR GOODWILL, ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS AGREEMENT, WHETHER IN CONTRACT, TORT OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS AGREEMENT WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE SOFTWARE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limits apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow some of these limitations, so they may not apply to you in full.

11. Refunds

If you are not happy with the Software for any reason, tell us within 14 days of purchase and we will refund it in full. A refund ends your licence: you must then stop using the Software, delete all copies, and stop using your licence key.

12. Export and lawful use

You may not use or export the Software in violation of applicable export control or sanctions laws, and you confirm you are not located in a country subject to a comprehensive embargo by the United States government, and are not on any restricted-party list.

13. General

Governing law. This Agreement is governed by the laws of the State of Louisiana, without regard to its conflict-of-laws rules. The state courts located in Orleans Parish, Louisiana, and the United States District Court for the Eastern District of Louisiana will have exclusive jurisdiction, and both parties consent to venue there. If you are a consumer, this does not deprive you of the protection of mandatory rules of the country where you live.

Entire agreement. This is the whole agreement between us about the Software, and it replaces any earlier understanding about it. The third-party licences in Section 3 are the exception: they stand alongside this Agreement and are not replaced by it.

Severability. If any provision is held unenforceable, it will be limited or removed to the minimum extent necessary, and the rest stays in force.

No waiver. If we do not enforce a provision, that is not a waiver of it.

Changes. We may issue a revised Agreement with a future version of the Software. The revised terms apply to that version, not retroactively to versions you have already licensed.
